What Does a Washington Excavation Contractor Need to Register With L&I?
Washington has no separate excavation license. Excavators register as contractors with the Department of Labor & Industries (L&I), as a specialty or general contractor. Registration requires a $15,000 bond for specialty contractors or $30,000 for general contractors (amounts that rose on July 1, 2024 and apply at your next renewal), plus general liability of at least $200,000 public liability and $50,000 property damage, or $250,000 combined single limit, with L&I listed as certificate holder. Most GCs and public agencies still require $1M per occurrence / $2M aggregate, and a lapse in your bond or insurance can suspend your registration.
One cut fiber line or gas main can cost more than a year of premium. Washington's dig law requires you to call 811 two to ten business days before digging, mark the area in white, and, since January 1, 2026, wait for a positive response from every utility operator before you start. Many contractor policies quietly limit underground damage, collapse or pollution. General liability pays when your work damages someone else's property or injures someone who isn't your employee. For excavators, the most common claims are struck underground utilities, damaged driveways and landscaping, undermined foundations next to a dig, and settling that shows up after the job is finished. That's why XCU (explosion, collapse, underground) and completed operations coverage matter as much as coverage during the job.

Every Washington contractor must keep a bond on file with L&I: $15,000 for specialty contractors and $30,000 for general contractors. We can often issue L&I bonds the same day, with a quick quote and no long application.

Washington is a monopolistic state: workers' comp comes only from L&I, not from private insurers. Excavation is generally risk class 0101, which covers excavation, land clearing and grading; sewer, pipeline and utility work can fall under other classes. Premiums are reported by hours worked. Because L&I coverage doesn't include employers liability, general contractors usually require a stop gap endorsement on your general liability policy, and we add it to your GL. 5 Excavation Exclusions That Can Leave You Uninsured
1. XCU exclusion (explosion, collapse, underground)
Excludes damage to underground utilities, collapse caused by digging, or blasting. For an excavator, this can remove the coverage you need most.
2. Earth movement or subsidence exclusion
Excludes claims from soil settling, shifting or sliding. Common after foundation digs, retaining walls and grading.
3. Pollution exclusion with no separate policy
Standard GL excludes contaminated soil and fuel spills. Without contractor's pollution coverage, a spill on site may be yours to pay.
4. Subcontractor and action-over exclusions
Some policies require every sub, including haulers, to carry their own insurance naming you as additional insured, or a claim on that job may be denied. Others exclude claims where an injured worker sues the GC, who passes the claim to you. Many GCs require that exclusion removed.
5. Residential or tract housing exclusion
Excludes work on homes or new developments, which can cut out a large share of an excavator's jobs. We review these provisions before you sign and tell you plainly what's covered and what it would cost to fix.

Do I need a special license to do excavation work in Washington?
No. Washington has no separate excavation license. You register with L&I as a specialty or general contractor, with a bond and general liability insurance.
Does general liability cover hitting an underground utility line?
It can, if your policy doesn't exclude underground damage (the "U" in XCU) and you followed Washington's dig law, including calling 811 at least two business days ahead. Check your policy for an XCU exclusion before you dig.
Can I buy workers' comp from a private insurer in Washington?

Can I get insurance if I've had claims or I'm a new business?
